Plumbing Leak or Wiring Problem: Attached letter identifies responsibility for plumbing and other maintenance issues within each unit and the above reference guide gives more details regarding plumbing leaks. Please read this letter carefully as it specifically advises: “…owners are responsible to contact their own plumber, electrician, or other maintenance contractor when experiencing a leak or wiring problem specific to that owner’s unit". Please keep in mind that all upper unit owners that are affected by the particular problem, especially in a plumbing/water leak situation, must contact a plumber or other qualified contractor as quickly as possible to avoid causing damage to lower units and/or other adjacent property. Should it be found that a building component for which the owner is responsible causes a water leak (e.g., lines servicing a washing machine, a bathtub/shower, sink, water heater, etc.), that owner will be held responsible for the resulting damage. In this regard, owners should consider acquiring property insurance that conforms to the standards set forth in Section 8.6 of the CC&Rs. Naturally, owners may choose to notify and submit a claim to the owner’s personal insurance policy in the event that owner is involved in a water loss situation.….” The letter goes on to outline the process to request reimbursement from the Association if the cause of the problem and resulting damage is a component the Association is responsible for and reminds owners all interior repairs are ultimately the responsibility of the owner of the unit.
